Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Chiron Trainer application and related services (collectively, the "Service") provided by Olympus AI LLC ("Olympus AI," "we," "us," or "our"). By creating an account, starting a free trial, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. We do not knowingly collect information from or provide the Service to anyone under 18. We reserve the right to terminate accounts where we have reason to believe the user is under 18.
Geographic restriction: The Service is not available to residents of the European Union, European Economic Area, or United Kingdom at this time.
2. Account Registration & Activation
Access to Chiron requires a paid subscription. After completing checkout through our payment processor (Stripe), you will receive an activation code to connect the Service to Telegram. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to update that information as necessary. We reserve the right to suspend or terminate accounts that provide false information.
3. Subscription, Free Trial & Billing
- Free Trial: New subscribers receive a 7-day free trial. No charge is made during the trial period. If you do not cancel before the trial ends, your selected plan will begin billing automatically.
- Monthly Plan: Billed monthly at the current rate. Renews automatically each month until cancelled.
- Annual Plan: Billed annually at a discounted rate. Renews automatically each year until cancelled.
- Price Changes: We may change subscription prices upon 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.
- Cancellation: You may cancel at any time by contacting support@chirontrainer.com. Access continues through the end of your current paid period. No prorated refunds are issued for unused time on monthly plans.
Payments are processed by Stripe. Your payment information is stored and handled by Stripe in accordance with their privacy policy. We do not store full payment card details.
4. Refunds
Please see our Refund Policy for complete details. In summary: Annual Plan subscribers may request a full refund within 15 days of purchase. Requests after that window may be denied. Monthly Plan subscriptions are non-refundable.
5. Use of the Service
You agree to use the Service only for lawful, personal fitness and wellness purposes. You agree not to:
- Share your activation code or account access with others;
- Attempt to reverse engineer, scrape, or copy any part of the Service;
- Use the Service to train competing AI models or products;
- Submit false or misleading health information that could result in harmful advice being generated;
- Use the Service in any manner that violates applicable law.
6. Health, Fitness & Medical Disclaimer
Chiron provides general fitness coaching and nutrition guidance generated by artificial intelligence. It is not a licensed personal trainer, registered dietitian, physician, or any other type of licensed healthcare professional. The content generated by Chiron does not constitute medical advice, diagnosis, or treatment.
You acknowledge and agree that:
- You will consult a licensed physician or healthcare provider before beginning any exercise or nutrition program, particularly if you have or suspect any medical condition, injury, disability, or are pregnant or nursing;
- All physical activity carries inherent risk of injury or death. You voluntarily assume all such risks;
- AI-generated recommendations may be inaccurate, incomplete, or unsuitable for your specific circumstances. You are solely responsible for evaluating the appropriateness of any advice before acting on it;
- You will immediately stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any other concerning symptom;
- Olympus AI LLC expressly disclaims all liability for any injury, illness, death, property damage, or other harm arising from your use of or reliance on the Service.
7. Limitation of Liability & Release
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- OLYMPUS AI LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF PROFITS, DATA LOSS, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE;
- OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00);
- THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Exceptions: The liability limitations above do not apply to: (a) claims arising from our gross negligence or willful misconduct; (b) violations of applicable privacy laws; (c) any liability that cannot be excluded or limited under applicable law, including non-waivable statutory consumer rights.
BY USING THE SERVICE, YOU HEREBY RELEASE AND DISCHARGE OLYMPUS AI LLC AND ALL RELATED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING ANY EXERCISE OR NUTRITION ACTIVITY UNDERTAKEN IN CONNECTION THEREWITH.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR NEEDS.
9. Intellectual Property
The Service and all content, features, and functionality are owned by Olympus AI LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only.
You retain ownership of personal information you provide (workout logs, nutrition entries, etc.). By submitting such content, you grant us a limited license to use it solely to provide and improve the Service.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for up to 90 days, after which it may be permanently deleted.
You may terminate your account at any time by cancelling your subscription and contacting us to request data deletion.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law provisions.
Any dispute arising from these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English, in Wyoming. You waive any right to a jury trial or to participate in a class action with respect to any claim covered by this section.
13. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
Changes requiring affirmative consent: Any change to the arbitration clause, class-action waiver, jury trial waiver, data sharing practices, or subscription pricing requires your express agreement before taking effect. We will request this via email and will not apply such changes automatically.
